Welcome to SlugHub. By registering an account, scheduling a commute, posting on the
discussions board, or otherwise using SlugHub, you agree to be bound by these Terms and Conditions.
1. Disclaimer
of Warranties (“As-Is” Clause)
SlugHub is provided strictly on an “as-is” and
“as-available” basis for scheduling and coordinating shared
carpool rides (known as slugging), to and from designated destinations by taking advantage of the free three
or more vehicle occupants use of HOV lanes. The provided blog is intended for general communication and
information related to slugging, commuting in general, and or traffic updates and warnings. SlugHub, its
creators, operators, and affiliates, absolve themselves of any and all legal, financial, or personal
responsibility for any issues, incidents, injuries, damages, delays, losses, or liabilities
arising directly or indirectly from your use of SlugHub, your interactions with other users, or
participation in any carpools, slugs, or travel arrangements facilitated here.
SlugHub makes no warranties or representations, express or
implied, including but not limited to warranties of merchantability, fitness for a particular purpose,
accuracy, reliability, or non-infringement. We do not warrant that the app will be uninterrupted,
error-free, secure, or free of harmful components.
2. Limitation
of Liability
To the maximum extent permitted by applicable law, SlugHub, its creators, operators,
and affiliates shall not be liable for any
indirect, incidental, special, consequential, or punitive damages â including but not limited to loss of
profits, data, use, goodwill, or other intangible losses â arising out of or in connection with:
- Your use of, or inability to use, SlugHub;
- Any conduct, content, or interactions of any third party on or through SlugHub, including other users;
- Any carpools, slugs, or travel arrangements coordinated through SlugHub;
- Unauthorized access to or alteration of your data or transmissions;
- Any other matter relating to SlugHub.
In no event shall SlugHub's total aggregate liability to you for all claims
arising from or relating to these Terms or your use of SlugHub exceed any cost incurred to use
SlugHub. Some jurisdictions do not allow the exclusion or limitation of certain damages, so
some of the above limitations may not apply to you.

Indemnification
You agree to indemnify, defend, and hold harmless SlugHub, its creators, operators,
and affiliates from and against any and all
claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees)
arising out of or in connection with:
- Your use of SlugHub or participation in any carpool, slug, or travel arrangement;
- Your violation of these Terms and Conditions;
- Your violation of any applicable law, rule, or regulation;
- Any content you post, submit, or transmit through SlugHub, including blog posts, replies, and messages;
- Any dispute between you and another SlugHub user;
- Your negligent or willful misconduct.
This indemnification obligation will survive the termination of your account and
these Terms.
4. Binding
Arbitration & Class Action Waiver
Please read this section carefully â it affects your legal rights, including your right to file a
lawsuit in court.
You and SlugHub agree that any dispute, claim, or controversy arising out of or
relating to these Terms, your use of SlugHub, or any commute, match, blog post, or interaction facilitated
through SlugHub (collectively, "Disputes") will be resolved exclusively through
final and binding individual arbitration, rather than in court, except as set forth below.
- Arbitration Rules: Arbitration will be administered by the American Arbitration
Association ("AAA") under its Consumer Arbitration Rules then in effect. If AAA is unavailable, the
parties
will mutually agree on an alternative arbitration provider. The arbitrator's decision will be final and
binding and may be entered as a judgment in any court of competent jurisdiction.
- Individual Basis Only: All Disputes must be brought in the parties' individual
capacity, and not as a plaintiff or class member in any purported class, collective,
consolidated, or representative proceeding. The arbitrator may not consolidate more than one
person's claims and may not preside over any form of class or representative proceeding.
- Small Claims Exception: Either party may bring an individual action in small claims
court for Disputes within that court's jurisdictional limits, provided the action remains on an individual
(non-class, non-representative) basis.
- Costs: Filing fees and arbitrator costs shall be allocated in accordance with the
AAA Consumer Arbitration Rules then in effect. Each party bears its own attorney's fees unless applicable
law requires otherwise.
- Opt-Out Right: You may opt out of this arbitration provision by sending written
notice to SlugHub within 30 days of first accepting these Terms. If you opt out, you
retain the right to bring Disputes in court, but the class action waiver above still applies to the
fullest extent permitted by law.
- Governing Law & Venue: These Terms and any Disputes are governed by the laws of
the Commonwealth of Virginia, without regard to conflict-of-law principles. If arbitration is found
unenforceable for any reason, any litigation must be filed exclusively in the state or federal courts
located in Fairfax County, Virginia, and you consent to personal jurisdiction in those courts.
- Severability: If any part of this arbitration clause is found to be unenforceable,
the remaining provisions will continue in full force and effect.
5. Governing
Law
These Terms and Conditions, your use of SlugHub, and any Disputes arising therefrom shall be governed by
and
construed in accordance with the laws of the Commonwealth of Virginia, without regard to
its
conflict-of-law provisions. To the extent that any lawsuit or court proceeding is permitted under these
Terms
(including where the arbitration provision is found unenforceable or does not apply), you agree to submit to
the exclusive personal jurisdiction of the state and federal courts located in Fairfax County,
Virginia, and you waive any objection to venue in those courts.
If any provision of these Terms is held to be invalid, illegal, or unenforceable
by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible,
and
the remaining provisions of these Terms shall remain in full force and effect.

User-Generated Blog Disclaimer
SlugHub does not pre-screen, verify, or endorse statements, reviews, traffic updates, or media posted by
users on the Community Blog / Discussions tab. SlugHub, its creators, operators, and affiliates
assume zero legal responsibility or liability for any statements, claims, comments, errors,
offensive material, or misrepresentations made by users. You are solely responsible for all content you post
and any consequences thereof.
7. Community
Blog Posting Rules
The Community Blog / Discussions section is intended primarily for commuting-related
information, including but not limited to traffic updates, schedule changes, commuter lot
conditions, HOV lane status, transit pricing, weather impacts on commutes, and general slugging
coordination.
By posting on the Community Blog, you agree not to post any of
the following:
- Offensive or Inappropriate Content: Any material that is abusive, threatening,
harassing, hateful, discriminatory, vulgar, or otherwise objectionable.
- Indecent or Sensitive Material: Any sexually explicit, obscene, or graphically violent
content, including images, videos, or written descriptions.
- Personal Information of Others: Names, physical descriptions, photos, or any
identifying details of drivers, riders, or sluggers without their explicit written consent.
- Vehicle Identification: License plate numbers, vehicle descriptions, make/model
details, or photos of vehicles that could be used to identify specific drivers or riders.
- Unauthorized Photos or Media: Any photographs, screenshots, or recordings of other
users, their vehicles, or their personal property taken without consent.
- Solicitation: Any solicitation material, including but not limited to product
promotions, organization recruitment, religious messaging, or political endorsements and or statements.
- Copyrighted Material: By using this platform, you acknowledge that you are solely
responsible for verifying the copyright status of any content you share or consume. Furthermore, you agree
not to download, distribute, or consume any copyrighted material shared by other users in a manner that
violates United States copyright laws. SlugHub is not responsible for any copyright infringement committed
by users. Any copyrighted material belonging to third parties uploaded to the Blog are subject to the
Digital Millennium Copyright Act (DMCA) â see our DMCA Policy
for how to report infringing content or dispute a takedown.
Violations of these posting rules may result in content removal, account
suspension, or permanent ban at SlugHub's sole discretion. SlugHub reserves the right to remove any
content that violates these rules without prior notice.
8. Age
Restriction & Policy on Minors (18+ Only)
You must be at least 18 years of age to register an account, utilize SlugHub's services, or communicate on
the blog. Minors are strictly prohibited from using SlugHub to schedule commutes as a driver or rider
(slugger). Under no circumstances may a registered SlugHub user use SlugHub to facilitate, coordinate,
schedule, or accept rides for and from unaccompanied minors. Violation of this age policy will result in
immediate and permanent account termination.
9. Safety and
Slugging Conduct
Your safety is your responsibility. In addition to these Terms, you must read, understand, and adhere to
the general rules of slugging which
govern driver and rider refusal rights and safety suggestions.
